Torkonoo’s suit stalls as AG fails to file response – Kow Essuman

Kow Essuman, legal counsel to former President Nana Addo Dankwa Akufo-Addo, has sharply criticised the Attorney General’s handling of the ongoing legal matter involving Chief Justice Gertrude Torkonoo, describing the conduct as “extremely unfair and unconstitutional.”

In an interview, Mr. Essuman revealed that the Attorney General’s Department has yet to file its statement of case in the matter currently before the Supreme Court, despite being named as a defendant.

He explained that Justice Torkonoo initiated legal action at the Supreme Court after raising concerns that her constitutional rights had been violated.

“The Constitution clearly provides that where a person believes their rights have been infringed, the appropriate recourse is the courts. That is exactly what the Chief Justice has done,” he stated.

Mr. Essuman noted that while the Chief Justice initially sought an injunction, the Supreme Court declined to grant it, opting instead to hear the substantive case before making any consequential rulings.

“However, to date, the substantive issues have not been determined largely because the Attorney General has failed to file a response,” he said.

“I can confirm and anyone can verify this at the Supreme Court registry that the Attorney General, who is the defendant in these matters, has not filed a statement of case. There has been no response at all,” he added.

Describing the situation as troubling, Mr. Essuman argued that the Attorney General’s inaction not only delays justice but also compromises the fairness and constitutional integrity of the process.

“It is extremely unfair and profoundly unconstitutional, the way this entire matter has been handled,” he emphasised.
