The Supreme Court has unanimously dismissed an objection by former Attorney General Godfred Yeboah Dame challenging the role of acting Chief Justice Paul Baffoe-Bonnie in a case involving the suspension of Chief Justice Gertrude Torkornoo.
Mr. Dame had argued that it was procedurally improper and “unprecedented” for Justice Baffoe-Bonnie to both empanel and preside over proceedings concerning the sitting Chief Justice, suggesting the move could erode public confidence in judicial independence.
However, after a brief recess, the five-member panel comprising Justices Baffoe-Bonnie, Henrietta Mensah Bonsu, Yonny Kulendi, Amadu Tanko, and Ernest Gaewu reconvened and unanimously overruled the objection.
The court held that the concerns raised were not grounds to disqualify Justice Baffoe-Bonnie, affirming that the integrity of the judicial process would be maintained.
The ruling paves way for the case challenging the process of Chief Justice Torkornoo’s removal to proceed.
