Ofori-Atta requests virtual engagement with OSP

Former Finance Minister Ken Ofori-Atta is set to miss his appointment with the Office of the Special Prosecutor (OSP) today, Monday, June 2, due to reports of a sudden deterioration in his health.

His legal representatives communicated this update to both the OSP and the Human Rights Court, providing medical documentation that outlines his condition and the surgical procedures he will undergo shortly.

This situation has stirred renewed speculation about whether the OSP, under the direction of Special Prosecutor Kissi Agyebeng, will once again consider Mr Ofori-Atta a wanted person as declared earlier.

An earlier notice from the OSP indicated that such a designation could be forthcoming if the former minister did not appear as scheduled on June 2.

Meanwhile, Mr Ofori-Atta is seeking legal intervention at the Human Rights Court, contesting a previous designation by the OSP that listed him as wanted.

A ruling on this case is anticipated for June 18, 2025.

On May 28, the OSP announced via its official X (formerly Twitter) account: “The Human Rights Court has adjourned to 18 June 2025 for a ruling on a motion filed by former Finance Minister Kenneth Ofori-Atta, seeking to restrain the Office of the Special Prosecutor (OSP) from declaring him wanted, among other reliefs”.

His legal motion also seeks to compel the OSP to remove any social media content portraying him as a fugitive.

Although the motion has been initiated by his lawyers, it faces strong opposition from the OSP, with a legal battle expected to come to a head later this month.

Despite not being present, Mr. Ofori-Atta is reportedly cooperating with investigators and has expressed a willingness to engage with the inquiry through virtual means.

His legal team has suggested that, in line with the Electronic Transactions Act, a remote session could be arranged for the OSP to obtain his Caution Statement while he undergoes treatment.

The OSP has not yet decided whether to accept this proposal.
